Refund Policy

The signed agreement cannot be canceled except by mutual written consent of both Purchaser and Birch Photographers. If cancellation is initiated by the Purchaser in writing and agreed to by Birch Photographers in writing, Purchaser will be required to pay 50% of the total Event Fee. Otherwise, Purchaser shall be obligated to make full payment of the total Event Fee.

The signed agreement shall be excused by detention of Birch Photographers personnel by sickness, accidents, riots, strikes, epidemics, acts of God, or any other legitimate condition beyond Birch Photographers' control. If such circumstances arise, Birch Photographers will make all reasonable efforts to find replacement personnel at the agreed upon fees.  Should Birch Photographers be unable to procure such a  photographer Purchaser shall receive a full and prompt refund of all fees paid, including the Reservation Fee. Purchaser agrees that under all circumstances, Birch Photographers' liability shall be exclusively limited to an amount not to exceed the Event Fee, and that Birch Photographers shall not be liable for indirect or consequential damages arising from any breach of contract.

In the event the Purchaser (or the future spouse in regards to this agreement) is, or hereafter becomes, a member of the United States Armed Forces on extended active duty and hereafter the Purchaser (or the future spouse in regards to this agreement) receives permanent change of station orders to depart from the area where the Purchaser currently resides, then in this incident, the Purchaser may change the event date of this agreement with no penalty upon giving thirty (30) days written notice to Birch Photographers. If  the original photographer chosen by the purchaser is unavailable for the changed event date, then Birch Photographers will find replacement personnel at the agreed upon fees. The Purchaser shall also provide to Birch Photographers a copy of the official orders reflecting the change, which warrants a non-penalized event date change under this clause.
